Terms and Conditions

General Terms

• We do not allow Adult Material, warez, illegal MP3 or video sites or IRC Bots or links to sites with such content.
• The definition of Adult Material and warez is left entirely to the discretion of Consortium Hosting
• You may not store more data in your account than your allotted space allows.
• Your web space is for your use only. You must not divulge the password to any other person, and you should take reasonable precautions to ensure that it is not discovered by other people.
• Data stored on our servers is not guaranteed to be backed up. It is recommended that you keep an independent backup of all data stored on your virtual server.
• You may not run server processes (eg. talkers/IRC Bots) from your server.
• We will not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of services.
• When your account is closed, all files (including web pages, etc.) will be deleted.
• We reserve the right to cancel your account at any time without notice.
• We reserve the right to amend and update these Terms and Conditions at any time without notice.
• To protect your privacy we never distribute your name or e-mail address or any other personal details to any third parties.
• Users must not participate in any form of unsolicited bulk emailing or spam.
• By logging into your account, or uploading files to it, you are indicating your acceptance of these Terms and Conditions.

Refunds

• Since our packages are yearly, we expect you to commit for this period of time. If you cancel your account within your service period then we will not make any refunds on any unused portions of your account. The only exceptions to this are if:
• you cancel your account within seven days of it becoming activated. In this instance, you will be refunded the cost of the package.
• between the time of placing the order and the time of the order being processed, your chosen domain name becomes unavailable you will be offered an alternative. If there is no suitable alternative domain name, Consortium Hosting will refund the cost of the ordered package.

Telnet

• Telnet shell accounts are only available on Linux servers. Linux servers can be provided at an additional cost.
• Telnet shell accounts are made available for editing and setting up your web site. It is not a development platform for issues unrelated to your web site.
• You must not leave you home directory at any time.
• You must not attempt to gain the privileges of another user.
• Interfering with the following files will result in your telnet access being removed - .bash_history - .bash_logout - .bash_profile - .bashrc.

Bandwidth and Resources

• If your bandwidth usage reaches the points where it has an adverse affect on other clients we reserve the right to disable your site until you can reduce your bandwidth usage.
• If your web site is found to be monopolising the resources available such as CPU time, we reserve the right to disable your site until you can reduce such usage.

Web Pages

• Commercial use of web and ftp space is permitted.
• You will be responsible for the content of your pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate UK law.
• You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your page(s).
• We reserve the right to remove material deemed inappropriate from your web pages, without prior notice.
• We do not allow index sites which list links to illegal files on peer to peer networks such as eDonkey.
• We do not allow index sites which list links to illegal or "adult material".
• Web pages accessible from your site may not contain encrypted material.

Free Trials

• are entirely at the discretion of Consortium Hosting
• can be terminated without notice
• will be hosted under a randomly chosen sub domain of consortiumhosting.co.uk
• must adhere to all the Terms and Conditions of hosted packages
• will not have access to the Help and Support area

Indemnification

Customer agrees that it shall defend, indemnify, save and hold Consortium Hosting harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Consortium Hosting, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Consortium Hosting against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Consortium Hosting' server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Consortium Hosting' server.

Disclaimer

Consortium Hosting will not be responsible for any damages your business may suffer. Consortium Hosting makes no warranties of any kind, expressed or implied, for services we provide. Consortium Hosting disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by Consortium Hosting and its employees. Consortium Hosting reserves the right to revise its policies at any time.
